Supported Living and Inclusion of Court of Protection via Deprivation of Liberty
We are committed to upholding the dignity and rights of all the people we support. A fundamental aspect of this commitment is ensuring that every individual’s consent is sought and respected in all aspects of their care.
Informed Consent We believe that informed consent is a critical component of providing care. Our staff are trained to explain the details of treatments, procedures, or care plans in a manner that is understandable to our service users. We ensure that all service users, or their legal representatives, are fully informed about the implications and potential outcomes before any consent is given.
Voluntary Agreement Consent must be given freely, without pressure or undue influence from staff, family members, or other service users. Our policy is to provide the necessary time and space for service users to make their decisions comfortably.
Capacity and Representation We recognize that some people may lack the capacity to give consent. In such cases, we work closely with appointed legal representatives, family members, or advocates to ensure that people’s best interests are always at the forefront of any decision made. When necessary, we involve the Court of Protection to make decisions for those who lack the capacity to do so themselves, ensuring that any deprivation of liberty is legally authorized and, in the person’s, best interests.
Ongoing Process Consent is not a one-time event but an ongoing process. We regularly review care plans with the people we support to ensure that consent remains current and relevant. Service users have the right to withdraw consent at any time, and we have procedures in place to respect and respond to such decisions promptly.
Documentation All consents are documented thoroughly in the person’s personal care records. This documentation includes details of the discussions that took place, decisions made, and any changes or withdrawals of consent.
Support and Assistance We provide support and assistance to people who need help understanding the consent process. This includes access to independent advocates and translators where necessary, and the involvement of the Court of Protection when appropriate.
